Gun safety is a serious issue. According to data cited by the Pew Research Center, more Americans died of gun-related injuries in 2021 than in any other year. Everytown Research and Policy reports that an average of 486 people are killed and many hundreds more suffer serious injuries in Nevada each year. Ladah Law Firm is committed to helping victims and families get justice for gun violence that should never have happened. Along with other cases, our Las Vegas attorneys handle:

  • Gun Range Accidents: Visiting a gun range is a popular activity in the Las Vegas area, but, unfortunately, accidents can happen. These shooting-related accidents are largely preventable. They may occur due to improper supervision, poor staff training, faulty equipment, or inadequate safety protocols. Whether you are a seasoned shooter or a first-timer, you should be able to feel safe at a gun range. If you or your loved one was hurt in a shooting accident at a gun range, contact us today for a free consultation.
  • Gun Owner Negligence: Accidents caused by the negligence of gun owners can happen anywhere, from private homes to public spaces. These cases often involve improper handling, lack of secure storage, or failure to maintain safety when the firearm is not in use. Our firm is skilled in navigating the complexities of negligence claims, focusing on how the gun owner’s actions deviated from reasonable safety standards. Our Las Vegas shooting injury attorney is a strong, experienced advocate for justice.
  • Negligent Security: In situations where shootings occur on commercial properties, such as malls, nightclubs, or parking lots, the property owner may be held liable if it is found that adequate security measures were not in place. Our legal team assesses the security protocols that were in effect at the time of the incident, determining if negligence in maintaining a safe environment contributed to the accident. Contact our Las Vegas shooting injury lawyer today for a free, confidential review of your negligent security claim.
  • Wrongful Death Claims: Tragically, shooting accidents result in fatal injuries. In these cases, we represent the victim’s family in wrongful death claims, striving to provide closure and financial support for those left behind. Our Las Vegas wrongful death lawyers are compassionate, experienced advocates for grieving families. We are here to focus on all of your legal needs while you do what is right for yourself and your loved ones.
  • Mass Shooting Incidents: Unfortunately, mass shootings are a serious threat. The National Mass Violence Victim Resource Center (NMVVRC) defines a mass shooting as one in which four or more people were shot. Sadly, Las Vegas was the location of the single largest mass shooting in American history. In 2017 at the Route 91 Harvest Festival, 60 people and approximately 867 were injured in an attack launched from the Mandalay Bay Resort and Hotel. Of those injured, nearly half (more than 400) were themselves hit by gunfire. Mass shootings lead to complicated civil and criminal claims. There may be several defendants.

Every shooting incident requires a thorough investigation to ensure all factors are considered and responsible parties are held accountable. We are ready to thoroughly investigate your case, gathering the evidence you need to establish fault, including  witness statements, surveillance footage, and ballistic reports. We collaborate with forensic experts to reconstruct the sequence of events and establish liability. Notably, Nevada is a modified comparative negligence state (NRS 41.141). A person who is partially at fault for their own shooting injury still has the right to seek compensation so long as they are at fault for no more than 50 percent of the incident.

In Nevada, injured victims have the right to pursue compensation for the full value of their damages, including economic losses and non-economic losses. Shooting injury or shooting death claims can be especially difficult. At Ladah Law Firm, we fight aggressively to help victims and families secure the absolute maximum financial recovery, including for:

  • Property loss;
  • Ambulance transportation;
  • Emergency room treatment;
  • Hospital bills and other health costs;
  • Physical rehabilitative support;
  • Loss of wages and loss of future earnings;
  • Pain and suffering;
  • Mental anguish;
  • Disability or disfigurement; and
  • Wrongful death of a family member.

Country music superstar Jason Aldean had just taken the stage at the Route 91 Harvest festival when gunfire erupted from somewhere above the venue. Over the next 72 minutes, a heavily armed gunman named Stephen Paddock carried out the worst mass shooting in modern American history.

According to reporting from the Las Vegas Review-Journal at least 59 innocent people have been killed and 527 more have been injured. This horrific attack is a heartbreaking tragedy for the victims, their families, the City of Las Vegas and the entire country.

The Shooter Was Positioned in a Mandalay Bay Hotel Room

We have now come to learn that the attack was carried out from a hotel room at the Mandalay Bay Resort and Casino, in a large suite 32 stories up and more than 400 yards away from the concert site. Even more shocking is that authorities have learned that the murderer, who had rented out the room several days prior, had nothing short of a weapons arsenal inside it with him. According to Las Vegas Metro Police Department (LVMPD) Assistant Sheriff Todd Fasulo, law enforcement authorities recovered 23 guns and thousands of rounds of ammunition in the hotel room.

Why Wasn’t This Attack Stopped?

Stephen Paddock checked into his room at the Mandalay Bay on the afternoon of Thursday, September 28th. While his motivations are not cleareven after several years of investigation, investigators strongly suspect that he selected that specific hotel room because it provided a clear overview of the Las Vegas Strip, where the concert would be taking place that weekend.

According to Las Vegas law enforcement officials, at some point between Thursday afternoon and Sunday evening, the shooter was able to get 23 guns, including several automatic assault rifles, and an enormous amount of ammunition into his hotel room. Notably, investigators found “more than ten suitcases” in the room. It was later determined that the suspect largely used the freight elevator, with permission from the Mandalay Bay, to move the weapons into his room through suitcases.

A gunman bringing more than two dozen firearms into a hotel room, including military-style assault weapons, is almost unthinkable. There are serious questions about the security procedures at the Mandalay Bay. How did Stephen Paddock bring so many firearms into his hotel room without raising suspicion from security personnel? Was he screened at all? Why did security fail to discover that he had so many weapons on the property? Anyone familiar with Las Vegas knows that casinos are loaded with security personnel. If you so much as take a casino chip off of a table you will no doubt be immediately surrounded by security guards; yet, nothing was done in this case.

Security Breakdowns at Mandalay Bay

Under Nevada’s premises liability law, all Las Vegas hotels and casinos have a legal responsibility to provide reasonably safe and secure conditions at their properties. Unfortunately, it appears that the Mandalay Bay has failed to live up to its basic legal duties. A gun law expert told Fox News that poor security at Mandalay Bay was ‘concerning’. Security breakdowns at high-rise hotels put everyone at risk, including people outside of the venue.

Las Vegas Businesses Can Be Held Liable for Negligent Security

If it is determined that their security was unlawfully negligent, a Las Vegas business can potentially be held liable for a third-party attack. A negligent security claim is a very complex type of premises liability case, and it must be handled by a top-rated personal injury attorney. To bring a successful negligent security claim against a hotel, you must establish the following four things:

1. The hotel had a duty to look out for your safety;
2. The hotel, through its inadequate security, breached that duty;
3. A connection exists between the hotel’s lack of security and your injuries; and
4. You suffered real damage as a result of the attack.

These types of claims are always assessed on a case-by-case basis, so thorough investigation is required. In this case, if the Mandalay Bay had maintained proper luggage screening procedures or equipment, the shooter may not have been able to get 23 guns and thousands of rounds of ammunition up 32 floors to a suite overlooking the concertgoers. Ultimately, the tragic attack may have been prevented.
