Common Types of Birth Injuries

Causes of Birth Injuries

Injuries sustained by a newborn are not always inevitable. While it is true that there are some things that are outside of a doctor’s control that can increase the risk of birth injury, such as genetic factor, position of the baby, or mother’s weight, most birth injuries are preventable. In many cases, birth injuries would not have occurred but for:

  • The improper use of forceps or vacuum extractors;
  • Excessive force;
  • Pulling on the baby’s head or shoulder during delivery;
  • Improperly monitoring mom or baby’s vitals;
  • Improper administration of certain medications;
  • Failure to perform emergency cesarean section;
  • Surgical errors during cesarean section;
  • Failing to provide information to the mother regarding nutrition during pregnancy, (prescription) drug use, etc.; and
  • Otherwise mishandling a newborn during the birthing process.

In order to hold a doctor liable for harm, you will have to prove that the doctor breached the medical standard of care, which is the standard of care that another similarly trained physician in the same circumstance would exercise.
